REALTI - TERMS OF SERVICE

1. Acceptance of Terms

By accessing Realti, you acknowledge that:

• You have read and understand these Terms
• You are legally able to enter into a binding agreement
• Your use of the platform is governed exclusively by the laws of the State of Florida

These Terms apply to all users, including individuals, brokers, agents, investors, institutions, and entities.

2. Changes to Terms

Realti may update these Terms at any time.

If material changes occur, we will notify users via:

• Website update notices, or
• Direct communication (email or in-app notice)

Continued use of the platform after updates constitutes acceptance of the revised Terms.

3. Permitted Use

You may use Realti only for lawful purposes and in accordance with these Terms.

Permitted uses include:

• Viewing and analyzing property data
• Accessing analytics, reports, insights, and AI-generated information
• Using the platform for personal, investment, professional, or research use

You agree not to misuse Realti or access it in unauthorized ways.

4. Prohibited Uses

You may NOT, under any circumstance:

A. Scrape or Extract Data

You may not:

• Scrape, crawl, index, mine, harvest, or extract Realti data
• Use bots, spiders, scrapers, crawlers, automation tools, or scripts
• Copy listing photos, remarks, valuations, zoning data, or analytics
• Export or download data in bulk
• Use Realti data to build a competing product

B. Reverse Engineering & Security Bypass

You may not:

• Reverse-engineer any algorithm or system
• Circumvent authentication
• Evade API rate limits
• Probe or scan for vulnerabilities
• Attempt to access restricted or protected data

C. Illegal or Fraudulent Activity

You may not:

• Misrepresent your identity
• Misuse property data
• Violate MLS licensing rules
• Engage in harassment, fraud, or unauthorized access
• Interfere with platform functionality

Violations may result in immediate suspension, permanent bans, MLS reporting, or legal action under:

• Florida Computer Crimes Act (F.S. 815)
• Computer Fraud and Abuse Act (CFAA)
• Digital Millennium Copyright Act (DMCA §1201)
• Any applicable MLS enforcement systems

5. MLS, IDX & Licensed Data Restrictions

If Realti displays MLS data, you agree to:

• Comply with all MLS, IDX, and VOW rules
• Not store, screenshot, download, or redistribute MLS-licensed content
• Not remove or modify MLS-required attribution
• Understand MLS retains ownership of its listing data

Violations may result in:

• Legal action by Realti
• Enforcement by the MLS or board
• Civil penalties
• Revocation of access

6. No Appraisals, No Brokerage Services

Realti does NOT provide:

• Appraisals as defined under USPAP
• Broker representation
• Legal advice
• Surveying or zoning certification

Realti provides informational data and analytics only, including AI-generated insights, valuations, property scores, and market analysis.

These outputs may contain inaccuracies and must not be relied upon as a sole basis for real estate or financial decisions.

7. AI-Generated Content & Limitations

Realti uses AI to produce:

• Automated valuations
• Risk assessments
• Flood insights
• Market trend modeling
• Property intelligence

All AI outputs are:

• Estimates
• Subject to error
• Not guaranteed
• Not professional advice

You accept full responsibility for how you use AI-generated outputs.

8. Account Security

You are responsible for:

• Maintaining confidentiality of your credentials
• Restricting account access
• All activity occurring under your account

You must immediately notify us of any unauthorized access.

9. Intellectual Property

Realti owns:

• The platform
• Logos, trademarks, branding
• AI models and generated content
• Proprietary valuation methods
• Property intelligence systems
• All original content unless noted otherwise

You may not:

• Copy
• Reproduce
• Modify
• Distribute
• Sell
• License
• Train AI models on Realti content

Without explicit written permission.

10. Third-Party Data & Public Records

Realti incorporates data from:

• Public agencies (zoning, tax, FEMA, county records)
• Third-party data providers
• MLS organizations (where licensed)

Realti does not guarantee completeness, accuracy, or timeliness.

11. Disclaimers

Realti is provided "AS IS" and "AS AVAILABLE" without warranties of any kind.

We do NOT guarantee:

• Accuracy of property or valuation data
• Availability of services
• Error-free performance
• Compliance of third-party data
• Any specific investment or financial outcome

You use Realti at your own risk.

12. Limitation of Liability

To the maximum extent permitted under Florida law:

Realti is NOT liable for:

• Lost profits
• Inaccurate data
• Missed opportunities
• Real estate transaction outcomes
• Loss of revenue or investments
• Any consequential, indirect, or incidental damages

13. Indemnification

You agree to indemnify and hold harmless Realti Strategies LLC from any claims arising out of:

• Data misuse
• MLS rule violations
• Unauthorized redistribution
• Scraping activity
• Breach of these Terms
• Improper reliance on analytics or AI outputs

14. Termination

Realti may suspend or terminate your access:

• With or without notice
• For violations of these Terms
• For suspicious or high-risk activity
• For scraping or automated access
• At the request of an MLS partner

15. Governing Law

These Terms are governed exclusively by the laws of the State of Florida with exclusive venue in Sarasota County, Florida.

16. Arbitration Agreement

All disputes must be resolved through binding arbitration under AAA rules, held in Florida.

You waive:

• Class actions
• Jury trials
